A long-running political debate over Germany's prostitution laws has resurfaced, with CSU deputy parliamentary group leader Dorothee Bär renewing her call for a Swedish-style ban on purchasing sex — a proposal that industry groups and at least one state minister have publicly rejected.

The Case for a Ban

Bär has described conditions for sex workers in Germany as dire, arguing the country's 2002 legalization framework has failed to prevent exploitation and calling for what she terms a paradigm shift toward criminalizing buyers rather than sellers — the so-called Nordic or Swedish model, adopted first by Sweden in 1999 and since followed by several other countries. She's cited estimates placing the real number of sex workers in Germany far above the official registered count, arguing the gap itself reflects how little the current system actually protects people.

The Pushback

The Bundesverband für erotische und sexuelle Dienstleistungen, a national trade association representing the industry, has rejected the proposal, arguing a purchase ban wouldn't guarantee safety for sex workers and would more likely push activity further underground and out of reach of the protections ProstSchG currently provides. Josefine Paul, the Green party's family and equality minister in North Rhine-Westphalia, has taken a similar position, noting that German lawmakers already made a deliberate choice to regulate prostitution as a legal service with defined rules and boundaries, rather than criminalize it.

Where This Actually Stands

No purchase ban is currently law, and Germany's regulated framework under ProstSchG remains in effect nationwide.
